ALTERNATIVE INSTRUCTION:  DEFINITION OF "KNOWINGLY"

            A person acts "knowingly" if that person acts with an awareness:

            (1)  that his or her conduct is of a particular nature;

or

            (2)  that a particular circumstance exists;

or

            (3) that the conduct was reasonably certain to cause the result.1

COMMENTS

            1.  The Committee is of the opinion that the statutory definition of "knowingly" may be confusing to jurors.   Therefore, the trial judge may wish to use this definition in addition to, or instead of, the statutory definition.
